The Centre government of India has defined a new set of rules for Jammu and Kashmir domicile certificates, which includes those who have lived in the Union Territory for 15 years.

According to the new rule issued by the Centre government of India   –

“A person residing in Jammu and Kashmir for at least 15 years will now be eligible to be a domicile of the Jammu and Kashmir ”,

According to the latest gazette notification issued by the central government, Section 3A of the J&K Reorganization (Adaptation of State Laws) Order, 2020, under the J&K Civil Services (Decentralization and Recruitment) Act, has been introduced to define domicile as that who has resided for a period of 15 years in the UT of J&K or they must be studied in an educational institution located in the UT of Jammu and Kashmir for a period of seven years and also appeared in class 10th or 12th examination Before 5th of August 2019, 35-A of the Constitution (this 35-A  is now abrogated by the center government) empowered J&K Assembly to define a J&K resident, who alone were eligible to apply for jobs or own property (immovable ) in Jammu and Kashmir.

“In exercise of the powers conferred by the proviso to article 309 of the Consitution of India, read with section 15 of the Jammu and Kashmir Civil Services Act 2010, the government hereby directs in sub-rule (1) of rule 5 of the Jammu and Kashmir Grant of Domicile Certificate Rules 220, after S.No/Clause 6, the following shall be added,” the notice reads, attaching the revised clause in the table mentioned below.

Eligibility Criteria for Jammu and Kashmir Domicile Certificate

According to the new rule issued by the Centre government of India   –

“A person residing in Jammu and Kashmir for at least 15 years will now be eligible to be a domicile of the Jammu and Kashmir ”,

To be eligible for the grant of the Jammu and Kashmir Domicile Certificate by the Competent Authority any person must fulfill any of the following conditions:-

 

A person who has resided in the Union territory of Jammu and Kashmir for a period of 15 years or they studied for a period of seven years and also appeared in Class 10th /12th examination in an educational institution located in the Union territory of Jammu and Kashmir;

OR

A person who is registered as a migrant by the Relief and Rehabilitation Commissioner (Migrants) in the Union territory of Jammu and Kashmir;

OR

Children of those Central Government Officials, All India Services Officers, Officials of Public Sector Undertaking and Autonomous body of Officials of Statutory bodies, Central Government, Public Sector Banks, recognized Research institutes of Central Government and Officials of Central Universities and (they must have served in Jammu and Kashmir for a period of 10 years).

OR

Children of parents who fulfill any of the conditions in clause (1); or (2).

OR

Children of such residents of Union territory of Jammu and Kashmir as reside outside Union territory of Jammu and Kashmir in connection with their business employment or other vocational or professional reasons but their parents have must fulfill any of the conditions provided in clauses (1) or (2).

 

Procedure to apply online for Jammu and Kashmir Domicile Certificate

In order to avail Jammu and Kashmir Domicile Certificate, you have to follow the easy steps given below –

  1. Firstly you need to visit the  Official Website of the Jammu and Kashmir official portal.
  2. Now the home page of the Jammu and Kashmir official portal will open on your screen as shown below

  6. Now if you want to apply for a Domicile certificate you have to select  E-Services and from the list of departments, then select the General Administration Department, and then click on the Application for Domicile Certificate.
  7. Now a webpage will be displayed to you, on this webpage you have to fill in all the remaining details as per your eligibility criteria for a domicile certificate in Jammu and Kashmir and you also need to upload all the required documents and photographs.
  8. Finally, preview and apply.
  9. After finally applying you will receive a confirmation email on your registered Email Id for further references and details.

For checking the status of the Jammu and Kashmir Domicile Certificate, you need to follow the easy steps given below

  1. firstly you need to go to the official website e https://jk.gov.in/jkeservices/home
  2. here you need to log in using the username and password.
  3. Now on the homepage, you need to click on the status tab.

Important Instructions to follow for online Registration of Domicile certificate.

  1. Before applying the Service, User has to register themselves on the website using the Citizen Registration option given on login Screen.
  2. you have to upload the Passport size scan photo in jpg format, the background of the photo should be clear and the size of the photo is should be less than 50 kb.
  3. Please, note down the user id and password entered by the applicant during registration for future reference.
  4. Please, select the role type Citizen when you enter login credentials using Citizen Users ID and Password.
  5. After login, you have to click on the e-services from the left menu and thereafter you have to click on the department to which he has to avail of the service. for example. Domicile Service Using General Administration Department or Scholarship schemes under the Social Welfare Department.
  6. Please, note down the Citizen ID, Username, and Password after the successful registration, because it will be required at the time of availing of the service.
